🦀 Cargo Mate Privacy Policy

CyberBoost LLC ("Licensor," "we," "us," or "our"), a Florida limited liability company, is committed to safeguarding your privacy. This Privacy Policy ("Policy") outlines our practices concerning the collection, use, and disclosure of information through our Cargo Mate software, including all source code, object code, executable files, documentation, and related services (collectively, the "Software"), and any associated offerings.

Article I - Definitions

1.01 Personal Information

"Personal Information" means any information relating to an identified or identifiable individual, including but not limited to name, email address, postal address, telephone number, and account credentials.

1.02 Commercial Information

"Commercial Information" means data related to billing, payment card details, and transaction history associated with the Software or related services.

1.03 Technical Information

"Technical Information" means data collected automatically, including IP address, device identifiers, browser type, operating system, and usage patterns.

1.04 Professional Information

"Professional Information" means data related to company affiliation, job title, or other professional details provided in connection with the Software.

1.05 You or Your

"You" or "Your" means an individual or Legal Entity (as defined in the Cargo Mate Software License Agreement) interacting with the Software or our services.

Article II - Information Collection

2.01 Categories of Information Collected

We collect the following categories of information in connection with the Software:

  • Personal Information: To facilitate account creation, licensing, and user support.
  • Commercial Information: To process payments and manage license agreements.
  • Technical Information: To monitor and improve Software performance and security.
  • Professional Information: To support enterprise licensing and user verification.

2.02 Methods of Collection

We collect information through:

  • Direct submission by You via forms, account creation, or communications related to the Software.
  • Automated means, such as cookies, analytics tools, or log files generated by the Software.
  • Third-party sources, where permitted by applicable law, such as licensing partners or service providers.

Article III - Use of Information

3.01 Purposes of Processing

We process information for the following purposes:

  • To provide, maintain, and enhance the Software and related services.
  • To administer licenses, including verifying Small Entity or Commercial Use status as defined in the Cargo Mate Software License Agreement.
  • To process payments and manage financial transactions.
  • To communicate regarding Software updates, support inquiries, or licensing terms.
  • To comply with legal obligations and enforce the Cargo Mate Software License Agreement.
  • To protect the rights, property, and safety of Licensor, Software users, and others.

Article IV - Information Disclosure

4.01 Categories of Recipients

We may disclose information to:

  • Service providers acting on our behalf under strict confidentiality agreements to support Software operations.
  • Legal authorities when required by applicable law or to protect our legal interests.
  • Parties involved in corporate transactions, such as mergers or acquisitions, subject to confidentiality obligations.
  • Other parties, with Your explicit consent.

4.02 Prohibition on Sale

We do not sell Personal Information as defined under applicable privacy laws, including the California Consumer Privacy Act (CCPA).

Article V - Data Security

5.01 Security Measures

We implement reasonable administrative, technical, and physical safeguards to protect information collected through the Software from unauthorized access, disclosure, alteration, or destruction.

5.02 Limitation of Liability

While we strive to maintain robust security measures, no system can guarantee absolute security. To the maximum extent permitted by law, Licensor shall not be liable for unauthorized access or breaches beyond our reasonable control, as provided in the Cargo Mate Software License Agreement.

Article VI - Data Retention

6.01 Retention Periods

Information will be retained only for as long as necessary to fulfill the purposes outlined in this Policy, or as required by applicable law, regulation, or the Cargo Mate Software License Agreement.

Article VII - Individual Rights

7.01 Access and Correction

You may request access to or correction of Your Personal Information, subject to verification and applicable legal requirements.

7.02 Deletion

You may request deletion of Your Personal Information, subject to legal retention obligations or legitimate business purposes, including those under the Cargo Mate Software License Agreement.

7.03 Portability

Where technically feasible, You may request Your Personal Information in a structured, commonly used, and machine-readable format.

7.04 Objection and Restriction

You may object to or request restriction of certain processing activities, as permitted by applicable law.

Article VIII - Cookies and Tracking Technologies

8.01 Use of Cookies

We use cookies and similar technologies in connection with the Software to enhance functionality, analyze usage, and improve performance.

8.02 User Control

You may manage cookie preferences through Your browser or Software settings. Disabling cookies may impact certain functionalities of the Software.

Article IX - International Data Transfers

9.01 Cross-Border Transfers

Information may be transferred to and processed in jurisdictions other than Your country of residence. We ensure such transfers comply with applicable data protection laws, including appropriate safeguards where required.

Article X - Minors

10.01 Age Restriction

We do not knowingly collect Personal Information from individuals under the age of thirteen (13) or the applicable age of digital consent in relevant jurisdictions. If such information is collected, we will take steps to delete it promptly.

Article XI - Jurisdiction-Specific Provisions

11.01 GDPR Compliance (EEA/UK Residents)

For individuals in the European Economic Area (EEA) or United Kingdom:

  • Legal Basis: Processing is based on contractual necessity (e.g., Cargo Mate Software License Agreement), legitimate interests, legal obligations, or consent.

  • Supervisory Authority: You may lodge complaints with Your local data protection authority.

11.02 CCPA Compliance (California Residents)

For California residents:

  • Rights: You have the right to request disclosure, deletion, opt-out of certain disclosures, and non-discrimination.
  • Categories: We collect Personal Information as defined under the CCPA.
  • Sale: We do not sell Personal Information.

Article XII - Updates to this Policy

12.01 Amendments

We may update this Policy from time to time. Material changes will be communicated through the Software, our website (https://cargo.do), or other appropriate channels, with the updated Policy reflecting the effective date.

Article XIII - Governing Law and Jurisdiction

13.01 Governing Law

This Policy is governed by the laws of the State of Florida, without regard to its conflict of laws principles.

13.02 Exclusive Jurisdiction

Any legal action or proceeding arising from this Policy shall be brought exclusively in the federal or state courts in Pinellas County, Florida. The parties consent to the personal jurisdiction and venue of such courts.

13.03 Waiver of Jury Trial

To the extent permitted by law, each party waives its right to a jury trial in any legal proceeding arising from this Policy.

Article XIV - General Provisions

14.01 Entire Agreement

This Policy, together with the Cargo Mate Software License Agreement, constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, or discussions, whether oral or written.

14.02 Amendment

This Policy may only be amended by a written instrument signed by an authorized representative of Licensor. Licensor reserves the right to modify this Policy for future versions of the Software.

14.03 Severability

If any provision is held invalid, illegal, or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14.04 Waiver

No waiver of any term is deemed a waiver of any other term, nor is any waiver a continuing waiver unless expressly provided.

14.05 Assignment

You may not assign, transfer, or delegate Your rights or obligations under this Policy without Licensor's prior written consent. Licensor may freely assign this Policy. Any attempted assignment in violation is void.

14.06 Independent Contractors

The parties are independent contractors. This Policy does not create a partnership, joint venture, agency, employment, or similar relationship.

14.07 Force Majeure

Neither party is liable for delay or failure to perform due to causes beyond its reasonable control, including acts of God, war, terrorism, strikes, or government actions.

14.08 Interpretation

Section headings are for convenience only. Unless the context requires otherwise:

  • "Including" means "including without limitation."
  • "Or" is disjunctive but not necessarily exclusive.
  • Words in the singular include the plural and vice versa.
